Subscriber Terms and Conditions - you must accept the terms and conditions if you wish to register to obtain the Tesco Internet Access services.

| 1. USE OF TESCO.NET |
|
Tesco internet access is owned and operated by Tesco Stores Limited, a company registered in England and Wales whose registered office is at Tesco House, Cheshunt, Waltham Cross, Hertfordshire, EN8 9SL ("we", "us" or "our"). We will provide you with the online services available from time to time via Tesco internet access, which may include the use of email, webspace, usenet newsgroups and access to the www.tesco.net website (the "Service").
To enable you to use the Service, you are required to register as an authorised user. To register with the Service you must be over eighteen years of age. You must ensure that the details provided by you on registration or at any time are correct and complete and you agree that you may have only one Tesco internet access account per household at any one time.
If you want to collect any Tesco Clubcard points that are awarded for using the Service then you will need to have a Tesco Clubcard or a Tesco eClubcard. We are not able to add Tesco Clubcard points retrospectively. From time to time we may change the number of Tesco Clubcard points awarded for using the Service or withdraw them altogether.
You must be a BT fixed line telephony user. You may not use the Service if you are on the BT Light User Scheme. You must only use the Service from a maximum of two BT fixed lines with functioning Caller Line ID. You need to use the dialler software we provide you with in order to use the Service.
Please note that Tesco internet access is a residential service which is made available to you only for personal use and not for commercial or business purposes.

| 2. AMENDMENTS |
|
We may update these Terms and Conditions (including the Price List) from time to time and any changes will be notified to you via the email address provided to you following registration or via a suitable announcement on the Tesco.net website.
The changes will apply to the use of the Service 30 days after we have given notice.
If you do not wish to accept the new Terms and Conditions you should not continue to use the Service.
If you continue to use the Service after the date on which the change comes into effect, your use of the Service indicates your agreement to be bound by the new Terms and Conditions.

| 3. PAYMENT |
|
You must pay any applicable subscription fees and/or telephone call charges for use of the Service as set out in our price list.
Upon signing up for the Service you must provide us with valid credit card details. Your credit card will then be debited with the first payment due for the Services. You may continue to use this credit card for subsequent payments or alternatively we accept payment by monthly direct debit.
Direct debit payments can be arranged online or by way of a paper mandate sent to you in the post. Where payment for the Services is not received for whatever reason via direct debit, we will debit your credit card with the relevant payment due,
Advance charges for the Service are not refundable, unless otherwise stated. There are certain websites (mainly sites of an adult nature) that will offer access to their content via a premium rate telephone line. You will be responsible for paying these charges and they are not included in the fees and/or telephone call charges we charge you. These websites should tell you when a premium rate would apply, but we have no control over them and we will not be responsible to you for any call charges that appear on your BT phone bill, whether or not they tell you.

| 4. AVAILABILITY OF SERVICE |
|
To use the Service you will require an appropriate fixed BT telephone line. You are responsible for providing a suitable PC, modem and any other items of hardware or communications equipment necessary to enable you to access the Service.
You are responsible for ensuring that any software and hardware attached to the Service does not cause degradation of the Service. In particular computer viruses, worms and spam should not be distributed across the Service’s network from or through any software or hardware you have connected to the Service.
We cannot guarantee that the Service will be secure or free from viruses and other similar threats. We recommend that you protect your PC by the use of a firewall and virus checker.
You may have chosen to use the internet security software provided by Tesco. You acknowledge that it is not possible for us to guarantee that the internet security software will stop all viruses and other similar threats. We do not accept any responsibility for losses or damage suffered by you if the internet security software fails to detect a virus or other similar threat. You must make backup copies of all important files and documents on your PC. The internet security software offers some automated tools for controlling access to the internet by children. You acknowledge that these tools only provide limited protection and that it is your responsibility to ensure that your children are properly supervised at all times when using the internet.
You are responsible for ensuring that your PC's time clock is set correctly; failure to do this may result in additional charges during the unmetered period of the daytime service.
The dial-up connection for your pay as you go, anytime and daytime Service is only available from the telephone number(s) that you gave during registration or have subsequently notified to us.
We are unable to guarantee a fault-free Service all the time. You should report a fault in the Service to us by telephone, letter, fax or email. We will try to correct the fault as soon as we are reasonably able to. Your access to the Service may occasionally be restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will restore the Service as soon as reasonably practicable after any such restriction.
In order to maintain the quality of service for all our customers, your access to the anytime and daytime Service may be automatically disconnected after ten minutes of idle time or two hours of continuous use. You may however immediately reconnect to the Service. Tesco reserves the right to review this disconnection policy and the details of these disconnection periods will be posted on our website. You must not use software that will artificially give the impression that your computer is not idle. You must not use software that will automatically re-connect your computer if you have been disconnected. Concurrent usage sessions are not permitted.
We may give you instructions about the use of the Service concerning health and safety, the quality of the Service to other customers, or any other aspect of the Service. Such instructions form part of these Terms and Conditions and you agree to observe them.

| 5. ACCEPTABLE USE |
|
You agree to use the Service for lawful purposes only.
You are solely responsible for the creation, maintenance and design of all content on any website that you establish using the webspace provided with the Service.
You agree to obtain all necessary licenses and consents from owners of copyrighted material if you place that material on your website.
If your website generates abnormally high levels of traffic, we may move it and/or restrict access to it and you will be liable for any additional charges arising from our action.

| 6. UNACCEPTABLE USE |
|
You may not or allow anyone else to use the Service for any of the following purposes ("Unacceptable Use"):
· publishing, transmitting, linking to, disseminating or making available in any way any unlawful, harassing, defamatory, abusive, threatening, harmful, vulgar, obscene, racist or otherwise objectionable material
· publishing, transmitting, linking to, disseminating or making available in any way material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any relevant laws, regulations or code of practice
· committing or attempting to commit fraud or any other criminal offence
· gaining unauthorised access to other computer systems
· transmitting or causing to be transmitted mail bombs (automated emails that resend themselves to addresses within an address book), chain letters or pyramid schemes
· interfering with any other person's use or enjoyment of the Service
· heavy use of the Service that detrimentally affects the ability of others to connect to the Service
· breaching any laws concerning the use of public telecommunications networks
· interfering or disrupting networks or websites connected to the Service
· making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner
· infringing a trademark, copyright or any other intellectual property right
· breaching any other person's privacy rights and sending unsolicited advertising or promotional material
· carrying out port scanning/probing (which is an attempt to identify an open gateway into another internet user's machine)
· collecting names, account details or personal details of other users of the Service
· carrying out trade or any other commercial activity
· running a website or redirecting to a website where access is subject to a premium rate telephone charge
· impersonating any real or fictional individual or entities
· doing anything which disrupts the normal use of the Service for other users.
· registering multiple accounts or linking up various user's webspace so that it appears to be one large website
If, while using the Service, you discover anyone else who is carrying out any of the above activities, you should inform us immediately.
You will indemnify us against all losses, liabilities, costs and expenses reasonably suffered or incurred by us, all damages awarded against us under any judgment by a court of competent jurisdiction and all settlements sums paid by us as a result of any settlement agreed by us arising out of or in connection with any Unacceptable Use of the Service by you or anyone who gains access to the Service through you.

| 7. USER ID PASSWORD AND SECURITY |
|
You must use a unique user ID and password to access the Service, which will be created by us from the details you provide. We cannot guarantee that any mailbox name or other name requested by you ("Name") will be available or approved for use. If we have reasonable grounds for thinking that the Name you have chosen may be in breach of anyone's rights, or is allocated to another person, we may ask you to choose a replacement Name.
You agree to take all necessary steps to ensure that your password is kept confidential, secure and used properly. You are responsible for the security and proper use of any passwords provided to you in connection with the Service and we will not be responsible to you in the event that a person gains unauthorised access via your account.
You agree to inform us immediately if you have any reason to believe that your password has become known to an unauthorised third party or if the password is being or likely to be used in an unauthorised manner.
You agree not to share your password or the use of the account with any third party.
You agree to inform us immediately of any changes to the information that you provided when registering for the Service, including any changes to your account information.
If we have reason to believe that there is likely to be a breach of security or misuse of the Service, we may change your password and notify you accordingly

| 8. STORAGE OF EMAIL AND WEBSITES |
|
You are responsible for checking your email regularly and storing any emails you wish to keep. Any emails kept on our servers will automatically be deleted after 120 days for read and unread messages. Mailboxes left dormant for 180 days will be closed and emails within deleted. The mailbox will only be reactivated by contacting the Call Centre.
Your mailbox is limited to 50mb.
If your mailbox exceeds 50mb any emails causing the mailbox to exceed this limit will be deleted.
When you reach the 50mb limit your mailbox is full. You will be unable to receive any more emails, and you will also be unable to save copies of emails that you send out.
You must keep your own back-up copies of your website and emails. We do not keep back-up copies of your website or emails and will not be liable for any loss or damage to them, however caused.

| 9. INTELLECTUAL PROPERTY |
|
The content of the www.tesco.net website is protected by copyright, trademarks, database and other intellectual property rights. You may retrieve and display the content of the www.tesco.net website on a computer screen. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the www.tesco.net website without our prior written permission.
No licence is granted to you in these Terms and Conditions to use any trademark of Tesco or its affiliated companies including, without limitation, the trademarks TESCO, TESCO.COM and TESCO CLUBCARD.

| 11. CONTENT |
|
It is not our policy to censor or restrict access to any material or information on the internet, nor do we examine the use to which customers put the Service or the nature of the information they are sending or receiving, unless required to do so by a competent authority. We may, however, refer any complaints regarding your use of the Service to the police or the Internet Watch Foundation for further investigation.
You accept responsibility for the supervision of minors with regard to the risk of inappropriate material. The Service may include settings that allow you to control access to certain sites, newsgroups and chatrooms. It is your responsibility to determine restrictions on access. The effectiveness of the settings depends on how you use and monitor them. We make no guarantees that the settings will filter out all inappropriate material.
The www.tesco.net website includes links to other websites, chatrooms, web search results or other materials which are beyond our control. We will not be responsible for content on the internet or world wide web pages outside the www.tesco.net website.

| 12. SUSPENSION AND CANCELLATION |
|
We may suspend or cancel the Service (including any website that you establish using the webspace provided with the Service) at our reasonable discretion or:
· if we have reasonable grounds to suspect that you are in breach any of your obligations under these Terms and Conditions;
· you do not pay the charges within 28 days of them becoming due; or
· you become the subject of bankruptcy or insolvency proceedings.
We will give you reasonable notice where possible however sometimes there will be serious grounds for suspending or cancelling the Service immediately.
We reserve the right to suspend your access to the Service if we believe your use of the Service causes the Service to be rendered less efficient or makes abnormal demands on the network from a single connection.
We reserve the right to remove any item available on the webspace provided with the Service or any other item or material made available via the Service by you or any other user at any time and without notice.
You may cancel this agreement at any time within seven working days, beginning on the day after your order for the Service has been confirmed via email (the “Cancellation Period”) by telephone on 0845 650 8000. In this case you will receive a full refund of any advance charges paid for the Service. We will process the refund due to you as soon as possible and, in any case, within 30 days of the day you have given notice of your cancellation.
You can inform us that you wish to cancel this agreement following the expiry of the Cancellation Period at any time by writing to us or call us on 0845 650 8000. If you do so, this agreement will end and you must therefore stop using the Service either immediately or at the end of the period for which you have prepaid. You must continue to comply with this agreement until the time you stop using the Service.
We can inform you that we wish to cancel this agreement at any time by writing to you giving you 30 days notice. If we do so, this agreement will end and you must stop using the Service at the end of the notice period. You must continue to comply with this agreement until the time you stop using the Service.
On termination of the agreement for any reason, we may delete your website and any emails from our server without any liability to you.
The suspension or cancellation of the Service shall not affect either party's rights or liabilities.

| 13. OUR RESPONSIBILITIES TO YOU |
|
We do not in any way exclude or limit: (i) our liability for death or personal injury caused by our negligence or that of our agents; (ii) any liability under Part 1 of the Consumer Protection Act 1987; or (iii) any liability that cannot by law be excluded or limited. All exclusions and limitations of liability in these Terms and Conditions are subject to this paragraph.
We will not in any event be responsible or liable for: (i) any faults, damage or maintenance to your telephone line; (ii) any loss of profit, revenue, business, contract, anticipated savings, goodwill or data or any similar financial loss; or (iii) any indirect or consequential loss or damage even if we could foresee, or were informed of the possibility of, these losses or damage.
In all circumstances where we are liable to you, whether the liability relates to negligence or otherwise, our total liability to you in any year is limited to one year’s charges.
We: (i) make no warranties, conditions, guarantees or representations as to the quality or fitness for a particular purpose of the Service or any other warranties, conditions, guarantees or representations whether express or implied, oral or in writing, except as expressly stated in this Contract; and (ii) exclude all liability for:
(a) the accuracy (or inaccuracy) of any material or other information provided or made available by any third party in relation to the Tesco.net Service;
(b) any third party goods or services purchased or obtained by you or any transactions entered into by you using the Tesco.net Service; and
(c) the transmission or reception of, or any failure to transfer or receive, any information or software.

| 14. ADVERTISING AND SPONSORSHIP |
|
Part of the www.tesco.net website may contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the www.tesco.net website complies with relevant laws and codes. We will not be responsible for any error or inaccuracy in advertising and sponsorship material.

| 15. APPLICABLE LAW |
|
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and any disputes will be decided only by the English courts.

| 16. MOVING FROM ONE TESCO INTERNET ACCESS PACKAGE TO ANOTHER |
|
If you are moving from one Tesco internet package to another (i.e. moving from Tesco dial-up to Tesco broadband or from one Tesco broadband package to another), you will need to agree to the terms and conditions relating to that package, including subscription to a new 12 month contract.

| 17. MISCELLANEOUS |
|
Calls to our customer services department may be monitored for training purposes.
You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions.
If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.
If you breach these Terms and Conditions and we ignore this, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.
We will not be responsible for any breach of these Terms and Conditions caused by circumstances beyond our reasonable control including for example acts of God, exceptionally severe weather, industrial disputes, failure or shortage of power supplies, act of terrorism or riot, war, default or failure of a third party (including any network operator or service provider) or their telecommunications systems or government actions.
A person who is not a party to these Terms and Conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions but this shall not affect any right or remedy of a third party which exists or is available apart from that Act.

By applying to join the Service we will make an application on your behalf to upgrade your phone line to support an ADSL service.
If the application is successful and provided that you have met and continue to comply with all these terms & conditions, you will be provided with the Service.
If we are unable to provide you with the Service because your phone line will not support it, we will notify you as soon as possible.
We are unable to guarantee a fault-free Service all the time. You should report a fault in the Service to us by telephone, letter, fax or email. We will try to correct the fault as soon as we are reasonably able to. Your access to the Service may occasionally be restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will restore the Service as soon as reasonably practicable after any such restriction.
Our unlimited broadband Services have no limits on the amount of access you may have to the system or the amount of data you may download. However, we reserve the right to review this policy for the benefit of the majority of users and may introduce limits in the future. We will notify you if we change our policy.
Our broadband Services with monthly download limits have specified usage allowances that restrict the amount of data you can download and upload per month. We reserve the right to review the specified usage allowances and will notify you if we change these.

| 11. CONTENT |
|
It is not our policy to censor or restrict access to any material or information on the internet, nor do we examine the use to which customers put the Service or the nature of the information they are sending or receiving, unless required to do so by a competent authority. We may, however, refer any complaints regarding your use of the Service to the police or the Internet Watch Foundation for further investigation.
You accept responsibility for the supervision of minors with regard to the risk of inappropriate material. The Service may include settings that allow you to control access to certain sites, newsgroups and chatrooms. It is your responsibility to determine restrictions on access. The effectiveness of the settings depends on how you use and monitor them. We make no guarantees that the settings will filter out all inappropriate material.
The www.tesco.net website includes links to other websites, chatrooms, web search results or other materials which are beyond our control. We will not be responsible for content on the internet or world wide web pages outside the www.tesco.net website.

| 12. SUSPENSION AND CANCELLATION |
|
We may suspend or cancel the Service (including any website that you establish using the webspace provided with the Service) at our reasonable discretion or:
· if we have reasonable grounds to suspect that you are in breach of any of your obligations under these Terms and Conditions;
· you do not pay the charges within 28 days of them becoming due; or
· you become the subject of bankruptcy or insolvency proceedings.
We will give you reasonable notice where possible however sometimes there will be serious grounds for suspending or cancelling the Service immediately.
If we cancel the Service for the above reasons during the initial term then we reserve the right to charge you the cancellation charge set out in the Price List.
We reserve the right to suspend your access to the Service if we believe your use of the Service causes the Service to be rendered less efficient or makes abnormal demands on the network from a single connection.
We reserve the right to remove any item available on the webspace provided with the Service or any other item or material made available via the Service by you or any other user at any time and without notice.
You may cancel this agreement at any time within seven working days, beginning on the day after your order for the Service has been confirmed via email (the “Cancellation Period”) by telephone on 0845 650 8000. In this case you will receive a full refund of the advance charges paid for the Service. We will process the refund due to you as soon as possible and, in any case, within 30 days of the day you have given notice of your cancellation.
This agreement has an initial term of 12 months. If you wish to cancel the Service following the expiry of the Cancellation Period during the initial term you must pay a cancellation charge which is set out in the Price List .
If you wish to cancel the Service following the expiry of the Cancellation Period but prior to your activation date, a pre-activation cancellation charge (which is set out in the Price List) may be levied to cover work undertaken by BT.
After the initial term there is no cancellation charge.
If you move house and want to relocate the Service to your new address (or if for any other reason you want to change the telephone line which you use for the Service) then we reserve the right to charge you the relocation charge set out in the Price List. We may also require you to start a new initial term of 12 months from the connection to the new telephone line. If you wish to cancel the Service prior to your activation date on the new line a pre-activation cancellation charge (which is set out in the Price List) may be levied to cover work undertaken by BT.
You can inform us that you wish to cancel this agreement after the expiry of the Cancellation Period by giving at least 30 days notice to us in writing, or by telephone on 0845 650 8000
If you do so, this agreement will end and you must therefore stop using the Service at the end of the period for which you have prepaid.
We can inform you that we wish to cancel this agreement at any time by writing to you giving you 30 days notice. If we do so, this agreement will end and you must stop using the Service at the end of the notice period. You must continue to comply with this agreement until the time you stop using the Service.
On termination of the agreement for any reason, we may delete your website and any emails from our server without any liability to you.
The suspension or cancellation of the Service shall not affect either party's rights or liabilities.

| 13. MOVING FROM ANOTHER SERVICE PROVIDER TO TESCO BROADBAND |
|
If you are already a broadband customer with another service provider and wish to migrate to Tesco broadband you will need to present us with a Migration Authorisation Code (MAC). You will need to contact your existing broadband provider to obtain this code and agree the termination of your account with them.
Once you have your MAC key, you can contact us to subscribe to Tesco broadband. New subscribers to Tesco broadband who migrate from another service provider are subject to the standard Tesco broadband terms and conditions, and will be subject to a new 12 month contract.

| 14. OUR RESPONSIBILITIES TO YOU |
|
We do not in any way exclude or limit: (i) our liability for death or personal injury caused by our negligence or that of our agents; (ii) any liability under Part 1 of the Consumer Protection Act 1987; or (iii) any liability that cannot by law be excluded or limited. All exclusions and limitations of liability in these Terms and Conditions are subject to this paragraph.
We will not in any event be responsible or liable for: (i) any faults, damage or maintenance to your telephone line; (ii) any loss of profit, revenue, business, contract, anticipated savings, goodwill or data or any similar financial loss; or (iii) any indirect or consequential loss or damage even if we could foresee, or were informed of the possibility of, these losses or damage.
In all circumstances where we are liable to you, whether the liability relates to negligence or otherwise, our total liability to you in any year is limited to one year’s charges.
We: (i) make no warranties, conditions, guarantees or representations as to the quality or fitness for a particular purpose of the Service or any other warranties, conditions, guarantees or representations whether express or implied, oral or in writing, except as expressly stated in these terms and conditions; and (ii) exclude all liability for:
(a) the accuracy (or inaccuracy) of any material or other information provided or made available by any third party in relation to the Service;
(b) any third party goods or services purchased or obtained by you or any transactions entered into by you using the Service; and
(c) the transmission or reception of, or any failure to transfer or receive, any information or software.

| 15. ADVERTISING AND SPONSORSHIP |
|
Part of the www.tesco.net website may contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the www.tesco.net website complies with relevant laws and codes. We will not be responsible for any error or inaccuracy in advertising and sponsorship material.

| 16. APPLICABLE LAW |
|
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and any disputes will be decided only by the English courts.

| 17. MISCELLANEOUS |
|
Calls to our customer services department may be monitored for training purposes.
You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions.
If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.
If you breach these Terms and Conditions and we ignore this, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.
We will not be responsible for any breach of these Terms and Conditions caused by circumstances beyond our reasonable control including for example acts of God, exceptionally severe weather, industrial disputes, failure or shortage of power supplies, act of terrorism or riot, war, default or failure of a third party (including any network operator or service provider) or their telecommunications systems or government actions.
A person who is not a party to these Terms and Conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions but this shall not affect any right or remedy of a third party which exists or is available apart from that Act.
If an item becomes faulty please contact us on 0845 650 8000 or at support@tesco.net. If the fault has occurred within the 12 month warranty period, you should return the item to us and we will arrange for a replacement or refund. If the fault is caused by accident, misuse, negligence or abuse of the item, including damage caused by electrical storm that could have been prevented by use of a surge protector it will not be covered by the manufacturer's 12 month warranty and you will not be able to get a replacement or refund.

Pre activation cancellation charges:
- If you cancel your order before your activation date has been given there will be no cancellation charge
- If you cancel 3-5 days prior to your activation date you will be charged £17.63
- If you cancel 2 days or less prior to your activation date you will be charged £52.88
Cancellation on or after your activation date:
- Tesco broadband has an initial term of 12 months. If you wish to cancel the Service during the initial term you must pay a cancellation charge of £70
- There will be a £100 cancellation fee if you cancel your Finest* broadband within the 12 month contract. No package change is permitted within the first 12 months. After the initial term you will not be able to change your package on-line, to change your package you will need to call our customer care on 0845 650 8000 (9am-9pm 7 days a week). If you wish to change to any other Tesco broadband or narrowband/dial-up package within your 12 month contract, you will be charged £100 cancellation fee or the remainder of your outstanding contract term, which ever is the lesser.
Relocation charges:
- If you move house and want to relocate the Service to your new address (or if for any other reason you want to change the telephone line which you use for the Service) we will require you to start a new initial term of 12 months from the connection to the new telephone line
- Relocation charge: Free
If you are moving from one Tesco internet package to another (i.e. moving from Tesco dial-up to Tesco broadband or from one Tesco broadband package to another), you will need to agree to the terms and conditions relating to that package, including subscription to a new 12 month contract.

TERMS & CONDITIONS FOR TESCO FINEST BROADBAND ADDITIONAL EQUIPMENT PURCHASE
|
|
These Terms & Conditions govern the way in which Tesco Stores Limited ("Tesco", "we", or "us") makes items available to you via the Tesco Finest* Broadband online shop (the "Site"). Please read them carefully as they affect your rights and liabilities under the law. If you do not agree to these Terms and Conditions, please do not purchase any items on the Site.
The Site is only available when you are purchasing or upgrading to Tesco Finest* Broadband and not otherwise.

1. Prices
|
|
The price payable for an item that you order is clearly set out on the Site. If, by mistake, we have under-priced an item, we will not be liable to supply that item to you at the stated price, provided that we notify you before we dispatch the item concerned. All prices are expressed inclusive of any VAT payable unless otherwise stated.
Product information is included on the Site and if there is anything which you do not understand, or if you want more information, please contact our Customer Services department on 0845 650 8000 or at support@tesco.net. For help with how to order an item online, please see the 'Help' section of the Site.
Please note that we will not award Clubcard points for any items purchased from the Site.

2. Availability
|
|
If an item is not in stock an 'out of stock' flag, with an 'e-mail me when this item becomes available' option, will be shown. If for any other reason beyond our reasonable control we are unable to supply a particular item we will not be liable to you except to ensure that you are not charged for that item.

3. Acceptance
|
|
There will be no contract of any kind between you and us unless and until we actually dispatch an item to you. Your order is an offer to buy from us. Nothing that we do or say will amount to any acceptance of that offer until we actually dispatch the item to you. At any point up until then, we may decline to supply the item to you without giving any reason. At the moment that the item is dispatched (and not before), a contract will be made between you and us, and you will be charged for the item. Where items are dispatched separately, then our acceptance of the order in respect of each item takes place when that item is dispatched, and you will be charged for each item when it is dispatched.

4. Delivery
|
|
Delivery will be made to the address specified by you when registering for Tesco Finest* Broadband.
Please note that we can only deliver items within England, Scotland, Wales and Northern Ireland. Items will be delivered by Parcelforce and must be signed for. If no-one is available at your address when Parcelforce tries to deliver, it will leave a card and you can pick up your items as explained on the card.
We do our best to secure delivery within 30 days of the date of your order but shall not be liable for loss occasioned by delay in delivery arising out of any cause beyond our control.
We aim to deliver your order within 3 to 7 working days.

5. Cancellation
|
|
You have the right to cancel your order up to 28 days after the day following receipt of an item by contacting our Customer Services department on 0845 650 8000 or at support@tesco.net. If the item has not been dispatched we will cancel the order and we will not take payment from your card.
If the item has been dispatched to you by Parcelforce you can refuse to sign for the delivery so that the item is returned to us and we will refund the price paid to your card. Alternatively, if you have already taken delivery please follow the procedure under 'Non-faulty items' in section 6 below.

6. Returns
|
|
We hope you will be happy with your purchase but should you wish to return any item please follow the instructions below.
Please note the following when returning an item:
- i) If you do not use our packaging to return an item you will be responsible for any loss or damage to the item during transit.
- ii) Items cannot be returned to a Tesco store.
Non-faulty items
If there is no fault and you would like to return an item, please let us know within 28 days after the day following the receipt of the item by contacting us on 0845 650 8000 or at support@tesco.net. We will provide you with addressed return packaging. When you return the item please remember to quote the returns reference number we have given you.
You are required to take reasonable care of all items. If an item is returned undamaged in its original and undamaged packaging, we will exchange it or offer a refund based on your original payment card.
Please note that we cannot return a non-faulty item to the manufacturer, so please return an item in its original and undamaged packaging with all of itsr components so that it can be re-sold as new.
We will remit a full refund of the price paid back onto the original payment card within 30 days of your notice of cancellation to us. We will refund the delivery charges unless you are not returning the whole order (in which case we will refund any delivery charges that would not otherwise have been payable). If you do not return an item within 28 days of the date of receipt of the return packaging, we will make a charge in respect of the cost of recovering (or attempting to recover) the item.If you do not return an item after our reasonable attempts to recover it, you will be deemed to have accepted the item, at which point a new purchase contract will be made and you will be charged for your order at the price set out on the Site.
Faulty items
If an item becomes faulty please contact us on 0845 650 8000 or at support@tesco.net. If the fault has occurred within the 12 month warranty period, you should return the item to us and we will arrange for a replacement or refund. If the fault is caused by accident, misuse, negligence or abuse of the item, including damage caused by electrical storm that could have been prevented by use of a surge protector it will not be covered by the manufacturer's 12 month warranty and you will not be able to get a replacement or refund.
Nothing in these Terms and Conditions shall affect your statutory rights. If you have any doubts about your statutory rights please contact your local Trading Standards Department or Citizen's Advice Bureau.

7. Payment
|
|
You can pay by any Mastercard or Visa credit card, Switch or Delta debit card. We do not currently accept Visa Electron cards. Your credit/debit card details will be encrypted to minimise the possibility of unauthorised access or disclosure. Authority for payment must be given at the time of order.
Please ensure that the expiry date of your payment card is after the anticipated dispatch date of your order. Payment is taken at the point of dispatch for an item and in the event that the payment card has expired we will be unable to take payment and fulfil your order.
Our liability to you in connection with any order will not exceed the total price charged for the relevant items.
We accept orders only from Web browsers that permit communication through Secure Socket Layer (SSL) technology, for example, 3.0 version or higher of Explorer and versions 3.02 or higher of Netscape. This means you cannot inadvertently place an order through an unsecured connection.

8. General

|
You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions.
